The terms for using TradeStarter HQ.

TradeStarter HQ provides tools for local service businesses to create and manage a customer-facing website, describe their services and service area, publish business information, and receive estimate requests from visitors.

The service may include account, onboarding, website, dashboard, estimate-request, and subscription functionality. We may update, add, limit, or discontinue features as the service changes, subject to these Terms and applicable law.

TradeStarter HQ is for business users who can enter into a binding agreement. If you use the service for a business or organization, you represent that you have authority to do so.

You are responsible for keeping your account credentials private, for activity through your account, and for promptly telling us if you believe your account or session has been accessed without permission. You must provide accurate account and onboarding information and keep it current.

You are responsible for the accuracy and completeness of the business name, contact information, service area or location, selected services, hours, and other information you provide. Review your published website and correct information that becomes outdated or misleading.

You are also responsible for your business conduct, customer communications, pricing, claims, licenses, permissions, and compliance with laws that apply to your business and the services you offer.

You retain the rights you have in the business information, images, copy, service descriptions, and other material you provide or approve for your website. You grant TradeStarter HQ a limited, non-exclusive license to host, format, generate, display, reproduce, and operate that content as needed to provide, maintain, secure, and improve the service.

You are responsible for having the rights and permissions needed for your content and for ensuring that it is lawful, accurate, non-infringing, and appropriate for a public business website. You must not submit content that violates another person’s rights, misleads visitors, or includes personal information that you do not have permission to publish.

An estimate request submitted through a customer website is a lead delivered to the applicable business. It is not a guaranteed job, quote, appointment, contract, revenue opportunity, or promise that work will be performed. The business decides whether and how to respond, what to charge, and whether to accept a project.

You are responsible for reviewing estimate requests, following up with leads, confirming project details, and handling any resulting relationship, quote, appointment, contract, or transaction directly with the person who submitted the request.

TradeStarter HQ may attempt to send operational or estimate-request notifications by email. Delivery can be delayed, filtered, rejected, or otherwise fail, and no notification method guarantees that a message is delivered, seen, or acted upon.

You are responsible for keeping your business contact information current, checking the dashboard, and responding to leads. TradeStarter HQ does not guarantee leads, revenue, rankings, traffic, bookings, conversions, customer responses, or business success.

The TradeStarter HQ Launch offer is currently $49/month. The subscription renews automatically each month until it is canceled. When you complete checkout, you authorize the recurring monthly charge for the selected subscription. Stripe processes the payment and related transaction services for TradeStarter HQ.

You can manage a subscription through Manage Billing and the Stripe customer portal. Under the current configuration, a cancellation takes effect at the end of the current paid billing period. You keep access to paid functionality through that paid period, and no further renewal is charged after the cancellation becomes effective unless you start or restore a subscription.

Cancellation and refunds are separate actions. Canceling a subscription does not by itself create a refund, and TradeStarter HQ does not promise an automatic refund. Refund requests are considered separately under applicable law and TradeStarter HQ policy. If a refund is approved, it is returned through the processor to the applicable original payment method where supported.

When paid access ends, paid functionality may become unavailable. Ending paid access does not necessarily delete a website, estimate requests, or business data, and TradeStarter HQ does not promise indefinite retention or hosting of that information unless expressly stated.

Use TradeStarter HQ only for lawful business purposes and in a way that does not harm the service, other users, visitors, or third parties. You may not:

TradeStarter HQ and its licensors own the platform, software, templates, design system, visual components, documentation, and underlying technology, including related improvements and intellectual property rights. These Terms give you a limited right to use the service while your account is permitted to do so; they do not transfer ownership of TradeStarter HQ technology to you.

You may provide feedback about the service. We may use feedback without restriction or compensation, provided that doing so does not disclose your confidential information.

The service may rely on third-party providers, including hosting, database, authentication, email, security, and payment providers such as Stripe. Third-party services may have their own terms, privacy practices, availability limits, and processing rules. TradeStarter HQ is not responsible for a third party’s independent services or acts, except as required by applicable law.

We work to operate a useful service, but TradeStarter HQ may be unavailable, interrupted, delayed, limited, or affected by maintenance, outages, security events, provider failures, internet conditions, or other circumstances. We do not promise uninterrupted or error-free operation.

We may change the service, these Terms, pricing, or feature availability. If a change materially affects the Terms, we will post an updated version and change the effective date. Your continued use after an updated version becomes effective means you accept the updated Terms, except where applicable law requires another process.

We may suspend or terminate access, limit functionality, or remove content when reasonably necessary for nonpayment, misuse, fraud, security concerns, threats to the service or others, or a material violation of these Terms. We may also stop offering the service, subject to applicable law.

You may stop using the service at any time. After access ends, paid functionality may become unavailable, and retention or hosting of websites, leads, or business information is not promised indefinitely unless expressly stated. Provisions that should reasonably continue after termination will continue, including ownership, disclaimers, limitations of liability, and dispute-related terms.

To the fullest extent permitted by law, the service is provided as available and without warranties of any kind, express or implied. We do not warrant that the service will meet every business need, produce leads or revenue, achieve rankings or traffic, generate bookings or conversions, or operate without interruption, errors, or security incidents.

To the fullest extent permitted by law, TradeStarter HQ will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to the service or these Terms. Our total liability for claims relating to the service will not exceed the amount you paid to TradeStarter HQ for the service during the twelve months before the event giving rise to the claim, or $100 if you paid nothing during that period. These limits do not apply to liability that cannot be limited under applicable law.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
